These terms apply when you use KayaShare. By creating an account or using the site, you agree to them. Please read them carefully.
1. Who may use KayaShare
You must be 18 or older and legally able to enter into contracts in South Africa. You may hold only one account, and the information you give must be true, accurate and kept up to date.
2. What KayaShare is (and isn't)
KayaShare is an online platform that introduces people looking to share accommodation. We are not an estate agent, landlord, letting agent or property practitioner, and we are not a party to any lease or house-share agreement between members.
Any agreement you make with another member is between you and them. Leases remain subject to the Rental Housing Act 50 of 1999 and, where applicable, the Consumer Protection Act 68 of 2008.
3. Your account and verification
You are responsible for keeping your login details safe and for all activity on your account. Trust badges show which checks a member has completed; they are not a guarantee of anyone's identity, character or conduct. Always use your own judgement.
4. Listings and content
Listings must describe real, available accommodation that you are entitled to let or share, with accurate rent, deposit and condition details. You may not post discriminatory, misleading, offensive or unlawful content, including content that breaches the Promotion of Equality and Prevention of Unfair Discrimination Act 4 of 2000.
You keep ownership of your content but give KayaShare a non-exclusive licence to display it on the platform. We may remove content or suspend accounts that break these terms.
5. Staying safe
- Meet in a public place first and view a property in person before paying anything.
- Never pay a deposit or rent before you've seen the property and signed a written agreement.
- Report suspicious listings or behaviour to us via the contact page.
6. Prohibited use
You may not use KayaShare for fraud, harassment, spam, scraping, commercial advertising unrelated to shared living, or anything that breaks South African law, including the Cybercrimes Act 19 of 2020.
7. Fees
Basic use of KayaShare is currently free. If we introduce paid features, prices will be shown clearly in rand, including VAT, before you pay.
8. Liability
To the extent permitted by law, KayaShare is not liable for losses arising from agreements, payments or interactions between members, or from the accuracy of member content. Nothing in these terms limits rights you have under the Consumer Protection Act that cannot legally be excluded.
9. Electronic communications
In line with the Electronic Communications and Transactions Act 25 of 2002, you agree that notices we send electronically are valid. Our details for the purposes of section 43 of that Act are available on request via our contact page.
10. Privacy
How we handle your personal information is explained in our Privacy Policy.
11. Changes and termination
We may update these terms and will show the latest date at the top of this page. You can close your account at any time. We may suspend or close accounts that breach these terms.
12. Governing law and disputes
These terms are governed by the laws of the Republic of South Africa. Please contact us first so we can try to resolve any complaint. Otherwise, disputes fall under the jurisdiction of the South African courts, Gauteng Division.
